By accessing or purchasing web design and development services from Omayik Digital (“we,” “us,” or “our”), you agree to be bound by the following Terms of Service.

1. Scope of Services

Omayik Digital provides website design, web development, custom software solutions, website maintenance, and related digital services. The specific scope, timeline, deliverables, and pricing for each engagement are outlined on our website pricing pages or individual service proposals.

2. Client Responsibilities

To ensure timely delivery, clients agree to:

Provide required content, text, media, brand assets, and access credentials promptly upon request.

Review deliverables and provide consolidated feedback within agreed-upon review windows (typically 3–5 business days).

Delays caused by late client assets or feedback may extend project completion dates accordingly.

3. Payments, Pricing & Billing

All prices are quoted in USD (or specified currency) and processed securely via Stripe.

Services must be paid according to the payment schedule outlined on the checkout or service agreement page.

We reserve the right to suspend work or delay project deployment if payment obligations are not met.

4. Intellectual Property Rights

Client Ownership: Upon receipt of full and final payment, the client receives ownership rights to the final website design, approved graphics, and custom code generated specifically for the client’s project.

Agency Rights: Omayik Digital retains ownership of pre-existing tools, proprietary frameworks, third-party libraries, and unapproved design concepts.

Portfolio Display: Omayik Digital reserves the right to showcase completed projects, screenshots, and case studies in our portfolio and marketing materials unless a formal Non-Disclosure Agreement (NDA) is executed prior to project kickoff.

5. Third-Party Plugins & Services

Projects may utilize third-party services, host providers, plugins, or software (e.g., WordPress plugins, hosting servers, API integrations). Omayik Digital is not liable for service outages, breaking changes, price increases, or security vulnerabilities caused by third-party providers.

6. Warranties & Limitation of Liability

All services are provided on an “as is” and “as available” basis.

Omayik Digital does not guarantee specific revenue, search engine rankings, or business performance resulting from website deployment.

To the maximum extent permitted by law, Omayik Digital’s total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project in question.

7. Governing Law

These terms shall be governed and construed in accordance with applicable local laws, without regard to conflict of law principles.
